Security of Information in Compliance with LGPD in Extrajudicial Service Offices

Abstract

The aim of this work is to bring concepts and information to Notaries, Registrars and their collaborators regarding the necessary procedural, technical, but above all cultural change in the day-to-day of Extrajudicial Services, in view of the requirements imposed by the General Law for the Protection of Personal Data, Law 13,709/18, which came into
force in September 2020. The methodological procedure was descriptive bibliographical research, using the following descriptors: General Law for the Protection of Personal Data, LGPD, Extrajudicial Registry Offices, information systems, information security. The bibliographical survey covered a period corresponding to the last six years, considering that Law nº 13.709, in line with the implementation of the LGPD, is dated 2018. The textual construction points out some important concepts and proposes reflection on routine/daily procedures of Extrajudicial Services, indicating basic actions for Officers and Notaries on security and information technology. The text was divided into two chapters of theoretical references, dealing with "The Phases of the Information System in Organizations" (Elements of Information Systems; Hierarchical Levels of Information) and "Notary Public Offices and Data Protection" (Concept of Activity Extrajudicial Notary and Public Faith; Information Security against LGPD Compliance; Impacts of LGPD on Notarial and Registration Services; Notary and Registration Activity in Data Protection; Operationalization of LGPD in Notary Public's Offices; Sensitive Personal Data; Subjects of the LGPD; Processing Activities; Security and Information Technology in Notary Public Offices). In this way, it is expected that the work will collaborate to stimulate a culture of computerization and engagement of the Officers so that the protection of personal data is consolidated, and, for this, training and improvements are necessary aimed at this specificity, making the Controllers and Employees better prepared to face the new era of technology that the world is experiencing.
